As part of its business activities, the Pension Fund of Karl Bubenhofer AG (hereinafter referred to as "the Foundation") collects and processes information about natural and legal persons ("Personal Data"), including information about our current, former, and future customers ("You"). The Foundation takes data protection seriously and processes personal data in accordance with the principles of the Swiss Data Protection Act (DSG).

This Privacy Policy describes how the Foundation collects and uses the personal data you provide to us. It also describes the rights available to you regarding the use of your personal data.

3. What Data Do We Collect?

We process personal data that we receive from our customers in the context of our business relationship.

Relevant personal data includes, among others:

  • Identification data (e.g., name, date of birth, title, AHV number)

  • Data related to the pension relationship (e.g., salary, employment status, information about balances, contributions, benefits)
  • Performance information from other social insurance (e.g., disability, accident, and sickness daily benefits insurance)
  • Particularly sensitive personal data (e.g., health data according to Art. 5 DSG
  • Privacy information (e.g., marital status)
  • Technical data (e.g. IP and MAC addresses, access logs, system information; see also Internet privacy policy)

Our data processing operations may in particular concern the following categories of persons, insofar as we process personal data in the process::

  • Customers, suppliers,
  • Customers in our shops and online shops;
  • People who use our services or who come into contact with our offers;
  • Users of our online services and apps;
  • Visitors to our websites;
  • Visitors to our premises;
  • People who write to us or otherwise contact us;
  • Recipients of information and marketing communications;
  • Contacts of our suppliers, customers and other business partners, organisations and authorities;
  • Job applicants.

The personal data processed by the Foundation comes from the following sources:

  • from employees, interested parties, customers, suppliers (e.g. within the framework of the contractual relationship or its initiation)
  • From the Foundation itself (e.g., information generated in the context of the pension relationship)
  • From third parties (e.g., brokers, court communications, social insurance or other pension institutions)

When you contact us (e.g., via a contact form, email, or telephone calls), we store your information to process the request in case of follow-up questions, for quality assurance purposes, or for other purposes described in this policy.

We store and use this personal data only if it is legally permissible. For special cases, we require separate consent from you. Unless specifically stated, we store personal data only for as long as is necessary and permissible to fulfill the purposes pursued.

4. For What Purposes Do We Process Data?

The Foundation processes the personal data listed above for the following purposes:

  • To initiate insurance and pension business
  • To carry out and administer insurance and pension business, especially for the assessment of benefit claims, calculation, and payment of old-age, disability, and survivor's pensions
  • For the settlement of benefits with third parties, especially social insurance (e.g., benefit coordination)
  • To implement regulatory requirements concerning the insurance relationship (e.g., calculation and certification of retirement assets)
  • For statistical purposes (e.g., insurance technical expert opinions, obligation evaluations, tenders)
  • To ensure compliance with and fulfillment of legal provisions

5. Disclosure and Sharing of Data with Third Parties

Personal data may be disclosed to the following recipients:

  • To other Group companies if this is necessary or helpful for the business activity.
  • Authorised representatives (e.g. medical officers, lawyers, survivors)
  • Social security and pension funds (e.g. ALK, FAK, accident insurance, pension fund)
  • IT and other service providers (e.g. banks, cloud services, forwarding companies, credit rating and collection services, marketing services, personnel services, consulting and support companies, backups or hosting on the systems of other KABE organisations)

 

The KABE organisation may also disclose your data to authorities or public bodies (e.g. social security, tax authorities, debt collection offices, courts, etc.) if this:

  • complies with applicable law, regulations, court orders or official requirements;
  • complies with any requirements of regulatory or other authorities or guidelines issued by them.

 

Data will only be disclosed if the disclosure or request for disclosure is made in accordance with the requirements of the KABE organisation.

 

We process and store personal data mostly in Switzerland and the European Economic Area (EEA/EU). However, in certain cases, we may disclose personal data to service providers and other recipients located or processing personal data outside this area. These countries may not have laws that protect your personal data to the same extent as in Switzerland or the EEA. If we transfer your personal data to such a country, we will ensure that your personal data is adequately protected.

6. Data Retention Period

The Foundation processes and stores personal data for as long as necessary to fulfill contractual and legal obligations. The statutory retention period is usually ten years after the end of the obligation to provide benefits or the payment of the exit benefit, with the possibility of longer periods in individual cases.

If personal data is no longer necessary for the fulfillment of contractual or legal obligations, it will be regularly deleted, to the extent technically possible, unless further processing of the data is required for overriding interests of the Foundation. The obligation to delete does not apply if this data is needed to assert or defend our own rights and claims; in this case, the Foundation is entitled to retain copies of this data to the extent necessary to assert or defend our rights and claims, while maintaining all security rules and principles of lawful data processing.

7. Protection, Processing, and Use of Personal Data

We limit access to your personal data to employees, agents, and other parties who need to know this data to provide you with services and benefits. When protecting your personal data, we take appropriate technical and organizational security measures. To this end, we use firewalls, personal passwords, as well as encryption and authentication technologies. The use and disclosure of your data is done exclusively in accordance with this Privacy Policy, except in cases where we have your consent or where disclosure is legally permitted.

Outsourced data processing

Demographic data collection by Google Analytics

This data comes from interest-based advertising from Google and third-party visitor data. This collected data cannot be attributed to any specific individual person. Google AdWords and Google Conversion Tracking
